They probably can't sue, true, not unless the contract signed beforehand stated that the artist signature couldn't be taken off the piece (and artists, maybe add this in to avoid trolls like the OP!). But Eric C*x, while it's not illlegal to do it- ethically, it's a poor choice.

Are you ok? Quite often when artists are commissioned, a contract is drawn up including price, timescales and anything the buyer actually wants. As standard on said contracts, the artists will include conditions such as no duplication of the piece and this almost always includes an agreement to not edit or modify the piece in any way. For a lawyer to take on a case with a contract in place, is a no brainer and easy pay day for them. So, how do i know this? Although i have never commissioned an artist for something i have purchased many pieces from local artists and each time i have signed a receipt or bill that has included a legal request not to modify the picture in any way. Well, it will depend from country to country, but even if all copyrights are transferred to the person commissioning the work the moral rights will often stay with the creator of the original work. Actually, in most European countries it is not even possible to assign or waive such moral rights. Based on such moral rights, which may include a right to the integrity of the work, the artist might sue the original poster.
