Zara Accused Of Stealing Designs From Independent Artists, And Here’s The Evidence

When Tuesday Bassen, an LA-based independent artist, started to receive letters from fans asking if she worked in collaboration with Zara, she was understandably confused. All became clear, however, when she noticed that the Spanish clothing brand had been using designs remarkably similar to her own. And by similar, we mean, well, the same.

She uploaded an image to Instagram that compared the popular clothing brand’s rather heavily inspired creations to her own products, writing “I’ve been pretty quiet about this, until now. Over the past year, @zara has been copying my artwork. I had my lawyer contact Zara, and they literally said I have no base because I’m an indie artist and they’re a major Zara clothing corporation and that not enough people even know about me for it to matter.” The story didn’t end there, however.     When designer Tuesday Bassen realized that Zara had been copying her work, she took to Instagram to highlight the issue

    “I’ve been pretty quiet about this, until now,” wrote Bassen on Instagram. “Over the past year, @zara has been copying my artwork (thanks to all that have tipped me off–it’s been a lot of you). I had my lawyer contact Zara, and they literally said I have no base because I’m an indie artist and they’re a major corporation and that not enough people even know about me for it to matter. I plan to further press charges but even to have a lawyer get this LETTER has cost me $2k so far. It sucks, and it’s super disheartening to have to spend basically all of my money, just to defend what is legally mine.”

    She uploaded an image to Instagram that compared Zara’s “creations” to her own. And as you can see, they’re pretty similar

    Bassen believes that the retailer “copied” four of her designs and so she contacted Zara store to highlight the suspicious similarities. And as you can see from the letter that followed, Zara’s response was somewhat dismissive, to say the least.

    Zara rejected her claims and said her work “lacked distinctiveness”

    Soon after Bassen raised the issue however, Adam J. Kurtz, a New York-based designer, made his own collage detailing other examples of Zara’s apparent plagiarism

    An update from Bassen read: “After speaking up about my art theft and@zara’s bullying tactics, several other artists have come forward that @Zara has stolen from. @ADAMJK is updating the list at @shoparttheft, but I will update you tomorrow with numbers of. Just. How. Much. Zara. Steals. From. Artists.”

    Adam also created a webpage called Shop ZARA’s Art Theft Collection that compiles stolen work and links them to the original artist’s page

    “Once is a mistake,” writes Adam on his website. “This many times is inexcusable. Global fashion retailer Zara appears to have stolen dozens of artworks from over 20 independent illustrators, designers, and brands including Tuesday Bassen (whose particularly awful case has gone viral) and Adam J. Kurtz (that’s me). Help us hold the company accountable to address this glaring intellectual property infringement directly and fairly compensate these artists.”

    Zara have since been in contact with Bassen, but the fight still goes on

    “They’ve now contacted me, and I’m having my lawyer speak to them. Will keep you posted! Thank you again for the outpouring of support. Your efforts are working, and I’m so appreciative. And tired.”

    While imitation is flattery, stealing is UNACCEPTABLE. This theft and forging of your hard work not only should be brought to justice, but hopefully you could regain some of the profits she stole as well. Good luck on your lawsuit.

    Some are very clearly 1 on 1 copies, terrible to get ripped off like that. I'm sure someone at Zara even got paid for this work to, but they should have responded way more professional, this is just bullying. The only thing missing from Bassen side is the dates on her designs, seems pretty important for this claim and the first thing I would add.

    this is discusting.. I've already given up shopping there due to poor quality and high prices but now I'm boycotting them for good. They are basically telling everyone they can do what they please, like they're some kind of gods, whether it's good or bad (in this case) and without any responsibility or consequence and we can all go .. ourselves as we are just ordinary people with little influence (although it's our money we spent there that makes them so rich and powerful).. well, being an ordinary person, I will no longer shop there!

    I don't approve of Zara stealing artwork but to be honest, google "heart lollipop" and you'll see virtual carbon copies of those designs. As much as I don't approve of what Zara is doing, most of the designs are hard to attribute to one person.

    I hope you win, Tuesday! It would mean a win for the entire community of artists who have their work often stolen but whose voices are never heard. This big corporations that charge a bomb but deliver sub-standard quality need to be yanked up by the neck.

    This has been happening to artists for a while now. Every once in a while I'll see another story just like this and its clear that the giant corporation just stole designs and motifs from artists. I believe Urban Outfitters has done this in the past, but because of the public out cry against it, they have since changed their "design procedure". It really sucks to try to make a living off your work and have giant corporations who could actually AFFORD to hire you, taking your working and making millions from it.

A blow on the water without consequences, with much grandstanding at the time and fading away a week later. Now 5 years later, was there a lawsuit? I don't think I cannot read the judgment by the court online. So again a lot of blabber

    Normally I don't too bent out of shape until the offending party is contacted and turn out to be douchebags. In this case, Zara can go to hell. I wish I had serious resources to fund that fight. It would be so fun to be a billionaire that could scare the c**p out of the company and publicly shame them. Normally I detest public shaming, but in this case I'd take out and ad showing the response and leaving it as the facts.

    Despicable attitude... Any big brand like this should in theory have its exclusive designs as it's highest selling point. This one is the most offensive, ridiculous slap in the face of artists and designers: It devalues their work, placing the value on the brand, as if it was a privilege to have your creation be used as an afterthought on an overpriced product for people more worried with showing off their buying power than good taste. And some designs are so simple, it's a certificate of incompetence for Zara's entire design team to resort to such a low expedient.

    While it is sad, this happens a lot especially with photography. Evrything you do now these days must be copyrighted or patented to be officially yours so No one else can touch it. That includes recipes, music, art, crafts, and photography. My friend is having a recipe copyright problem. She went into a baking business with her hubby and were selling a good using her recipe. The have since left not on best terms but bakery still using her recipe (it's one of the highest selling items. She can't do anything about it because it's not copyrighted to her. Just another lesson learned in the world of money making. ????

    If you look at copyright law, recipes are not and never have been copyrightable. Moreover, if anyone creates something wile in the employ of a business, in the course of their work for that business, any copyright which may exist belongs solely to that business, unless a different arrangement has been legally stipulated at the start of that employment.

    I don't support big companies like Zara that steal all kind of designs for profit, but clearly that artist is just another hipster claiming for attention. Her designs are so similar to other artists designs, just google her drawings and you'll find there are other drawings so similar to hers.     This post of course tells the story from one side and it is easy to blame big corporations. If only part of it is true, though, it displays extreme stupidity on the corporation's side in the age of social media.

    If you dont know, here in Brazil they were enslaving people from Venezuela and China. They are criminals, so, its not a big surprise to watch them stealing ideas from "ordinary people".
