Mom Facing Execution For Tragic Passing Of 2YO Daughter Declared “Actually Innocent” By Judge

Melissa Lucio, a mother of 14 condemned to the death penalty, had a critical update on her case today (November 15) after a judge determined she’s “actually innocent,” and recommended her 2008 conviction to be overturned.

Lucio, from Brownsville, Texas, was arrested in 2007 following the passing of her 2-year-old daughter, Mariah Álvarez, who was found unresponsive at home. Lucio was convicted of capital murder in 2008 and has since been fighting to clear her name.

The 55-year-old mother has consistently claimed that her daughter fell down the stairs accidentally and that she had nothing to do with the tragic incident. 

Judge Arturo Nelson of Cameron County District Court acknowledged Lucio’s version of events and found her innocent based on newly submitted evidence previously withheld by prosecutors.

Evidence against the mother relied on the state of her daughter’s body, which exhibited signs of trauma caused by a physical altercation. 

Mariah was bruised, scratched, and had signs of having been bitten that were reported by the paramedic team that tried to resuscitate her on February 17, 2007, after they were called to her residence due to the child being unresponsive.

Medical Examiner Dr. Norma Jean Farley asserted that the injuries could only have been caused by intentional abuse. Upon hearing the testimony and interviewing Lucio, Texas Ranger Victor Escalon determined that the mother was guilty based on her demeanor, which showed signs of guilt, such as avoiding eye contact.

Despite initially claiming that all of Mariah’s injuries were the result of an accident, Lucio retracted her claims in an interrogation afterward. The mother admitted to slapping, pinching, and biting her daughter but remained adamant that she didn’t cause her to fall.

Further complicating the case for Lucio were two things: the autopsy report and her history with Child Protective Services.

Investigators determined that Mariah’s bruises were not the result of a specific fight but the remains of a lifetime of physical abuse. The report also showed that the 2-year-old had broken her arm as far as seven weeks before her death, with Lucio failing to seek medical care.

Child Protective Services had previously investigated Lucio, determining that her children were neglected and that she was addicted to cocaine. Authorities decided to put most of them in foster care, with the three of them going to live with their father in Houston.

Kim Kardashian came to Lucio’s defense as the date for her execution neared in April 2022, successfully postponing it

The Lucio case gained renewed attention after Kim Kardashian became involved in April 2022, using her platform to advocate for clemency as her execution date of April 27 got near. The media mogul shared a letter from Lucio’s children, who pleaded for their mother’s life to be spared.

Kardashian was successful in her plea, leading to a stay of execution that allowed judges to review the case once again, resulting in the recent recommendation of overturning her conviction by Judge Arturo Nelson.

“[Lucio] met her burden of proof, by a preponderance of the evidence, that she would not have been convicted in light of the suppressed evidence,” Nelson stated

The case has now been moved to the Court of Criminal Appeals (CCA) and awaits its resolution.

There...is...no new evidence in this article that clears her? I'm confused about the whole point with this article? What evidence did the prosecutor withhold? What about the childs older injuries like the bitemark and the broken arm from before? I am against the death penalty but she doesn't sound very innocent from what I read in this article.

OK she may not have killed the child, but there was obviously a level of abuse going on that still needs to be addressed. I don't agree with the death penalty, but she's not innocent in regards to the physical abuse. The way the title is written makes it sound like she did nothing wrong.

She lost almost all her children to CPS due to neglect and abuse This child had multiple old injuries. Mum may be "only" guilty of involontary manslaughter but there is no "actual" innocence here.

Very confused and doubt we're getting all the facts on here, because everything stated shows the child was being abused/neglected and the abuse/negligence led to her death. Don't understand why the death penalty was reversed. Anyone else have clarification? Leaving a 2yr old to walk around with a broken arm and no medical care should've been enough for lethal injection. My grandmother made me walk on a broken ankle for 3weeks when I was 12yrs old because she refused to believe it was broken, it was agonizing, I can't imagine the pain this 2yr old was in.

Another "stellar" article by BoredPanda, where they leave out all meaningful information. The medical examiner had testified that the child's death could only have been caused by the various injuries (and that they had been intentionally inflicted within 24 hours of the child's death), and that the death could not have been caused by the fall, which had occurred 2 days prior to the child's fall). This was not true according to other experts, but that had been suppressed. And the Texas Ranger who testified that he could tell she was guilty because of the way she acted during the interrogation (which has been scientifically proven to be untrue, but people still think they can do that with 100% accuracy).. I still think she and her husband both deserve prison time for not getting medical care for the child as her condition deteriorated over 2 days after the fall, not to mention all the other child abuse issues. https://www.khou.com/article/news/local/texas/melissa-lucio-death-sent

There were old injuries and an untreated broken arm that happened well before the time of the "fall". Honestly, this is another nasty evil parent playing the "it wasn't murder, it was just neglect" card. That being said, she should have been charged with voluntary manslaughter unless they can prove she planned ahead to kill her child. Now we risk her getting off altogether. It should still be a life sentence...

Not a fan of the death penalty simply because I don't like having jurors having to decide someone should die. But her defense is that she beat the c**p out of her baby lotsa times, and THIS time the baby just happened to fall?

What was the new evidence? All this article says is that she admitted to biting, pinching, slapping and otherwise abusing her 2 year old daughter, and failing to seek medical attention for an earlier broken arm, but denied killing her. There was nothing in the article that suggested she was in any way innocent.

"The victim of physical, emotional, and sexual abuse from a young age, Ms. Lucio has been diagnosed with PTSD, battered woman syndrome, and depression, and has intellectual impairments, all of which, forensic and domestic abuse experts say, made her more vulnerable to coercive interrogation." the prosecution committed a Brady violation and submitted Agreed Findings of Fact and Conclusions of Law with defense counsel. This evidence included testimony from Ms. Lucio’s other children who denied physical abuse and confirmed Mariah’s accidental fall. Lucio and some of her children had recounted the fall to police officers and child protective services. Nelson ruled that this violated Lucio's constitutional rights and recommended the appeals court overturn Lucio's conviction and death sentence. “
