Not only this takes the attention and respect away from the real rape cases by making it seem like everything is rape, you're basically saying that guy at the party that you thought you were really into but in retrospect weren't really is the same as a rapist, and a guy who just had sex with the wrong girl should not have his life ruined for it.

What a load of c**p. "Regret" is something you experience after the fact and there's no "statute of limitations" on it. Therefore, by extension of Jesse's bizarre logic, if YEARS later she for some reason suddenly "regrets" having a tryst with someone, she now has grounds to accuse that person of rape. I suspect what we're dealing with here is a young woman who doesn't know the actual definition of the word "regret" and is inadvertently exposing her ignorance to the world at large.

i partly agree with both sides. if you have sex with someone and the next day you regret having sex with that person it is not rape. but if you are having sex with someone and feel that you don't want to do it anymore and actively try to stop the other person then it becomes rape if the other person does not stop.

As a matter of law after the act is done you can't retrospectively un-consent, if you consented in the first place. If someone pressures you to have sex and you submit in almost all circumstances the court will view that as valid consent. The only slightly valid point is that consent can be withdrawn during a sexual act, the person has to stop as soon as you withdraw your consent, but that doesn't retrospectively make the earlier sexual act unlawful.

This is a perfect example of why we need comprehensive education about consent in our sex ed/health classes taught in middle school. Also, actual sex ed rather than abstinence -focused curriculums would be great.
A boy that my son goes to school with was asked to stop mid act. It took him about 30 seconds and he asked "Do you want me to stop?" She said yes, and he did. Fast forward two years. The boy has been through two Title 9 investigations. Both times the girl agrees that the incident happened as stated above. She still alleges she was raped. The boy has cooperated fully both times and both times the independent investigator found that it was not rape. This girl has requested no contact orders at the VERY small liberal arts college that they both attend. She has made his life a living hell. She wants him kicked off of campus because SHE regrets the incident. We need to educate women and men so that this poor kid can finish his degree in peace.

When people say "that's not feminism" they want to reject what their religion is doing for what they personally believe. You can still recognize there is BAD that feminism does without saying "it's not feminism". Instead look at what the visible argument is being put out by the movement. I don't constitute regret as rape, but I did have an experience as a young woman that scarred me to this day. Not a violent rape, but sex with a "friend" who I was not attracted to, who well knew I was not into him. Sex that wouldn't have happened had he not found me obviously too drunk to make that decision. Sex I barely remember, because I was so drunk. I do not consider it rape, but I consider it somewhere close to it. He knew I was not into him, and I could barely move. The reality of what happened was very traumatizing. I went off the deep end after that. What do you call an act like that? One that takes all your innocence away. One you know was not okay on some major level. I'm sorry regretting it, does not constitute as rape. Now if she decided in the middle of it, she didn't want to have sex and carried on - that's a different animal. Regretting part way through is legitimate and does mean the other person has to stop, no matter how difficult and frustrating that is. And sadly I have heard a well known comedian do a riff on just such a situation where he was mocking the woman for thinking she could stop part way through. As a matter of law after the act is done you can't retrospectively un-consent, if you consented in the first place. If someone pressures you to have sex and you submit in almost all circumstances the court will view that as valid consent. The only slightly valid point is that consent can be withdrawn during a sexual act, the person has to stop as soon as you withdraw your consent, but that doesn't retrospectively make the earlier sexual act unlawful.

The boy has cooperated fully both times and both times the independent investigator found that it was not rape. This girl has requested no contact orders at the VERY small liberal arts college that they both attend. She has made his life a living hell. She wants him kicked off of campus because SHE regrets the incident. We need to educate women and men so that this poor kid can finish his degree in peace.

When people say "that's not feminism" they want to reject what their religion is doing for what they personally believe. I don't constitute regret as rape, but I did have an experience as a young woman that scarred me to this day. Not a violent rape, but sex with a "friend" who I was not attracted to, who well knew I was not into him. Sex that wouldn't have happened had he not found me obviously too drunk to make that decision. Sex I barely remember, because I was so drunk. I do not consider it rape, but I consider it somewhere close to it. He knew I was not into him, and I could barely move. The reality of what happened was very traumatizing. I went off the deep end after that. What do you call an act like that? One that takes all your innocence away. One you know was not okay on some major level. A betrayal of friendship for a cheap thrill. Or maybe a revenge f**k tot he girl who rejected him. It was humiliating. That was nearly 30 years ago, yet to this day I still shudder at the thought.

I'm sorry regretting it, does not constitute as rape. Now if she decided in the middle of it, she didn't want to have sex and carried on - that's a different animal. Regretting part way through is legitimate and does mean the other person has to stop, no matter how difficult and frustrating that is. And sadly I have heard a well known comedian do a riff on just such a situation where he was mocking the woman for thinking she could stop part way through. The number of women that do make false accusation of rape, whether or not it's because of regret, is very, very tiny (I got this from a Radio 4 programme on the law). Consent can not be revoked after sex but it can be revoked during. If one partner tells the other to stop, tries to get away, or passes out at any stage during sex and the other partner does not stop then it becomes rape, otherwise it is still consensual.
If you agree but want to stop and he or she does then it is not rape, but if she is telling you to stop, or repeatedly says know and you keep pushing it till she says yes then it is rape.
