Adopting a child can sometimes be complicated. This is especially true for those who sought custody of the kid because the biological parents were in some way unable to fulfill their duty. 

In this story’s case, a man adopted a young girl who tragically lost both of her parents. But that didn’t stop his sister-in-law from conducting a secret DNA test on the child out of sheer nosiness. 

The author responded by mocking his brother’s wife, subsequently resulting in family drama. He now asks the AITAH subreddit for validation on whether or not he went too far.

Consent is required when obtaining DNA from an underaged child

The author’s sister-in-law may have overstepped some boundaries here. According to the DNA Diagnostics Center (DDC), legal parents are the only ones allowed to do unconsented DNA testing. 

The sister-in-law should have obtained signed permission from the child’s legal guardian, who, in this case, is the author. The DDC states that testing wouldn’t be possible without said document.

Such protocols are necessary to prevent the mishandling of DNA, especially since law enforcement can use it as evidence. In the worst cases, this could lead to false accusations and potentially ruin lives. 

Paternity laws vary in states and regions, and the author didn’t specify his location. Therefore, it isn’t clear if the woman committed violations. However, her actions to satisfy her curiosity and rub it in her brother-in-law’s face is a bad look.

Dealing with a nosy relative requires a proper response

We’ve all dealt with that one relative who always has intrusive questions during family reunions. They are the ones who inquire about your romantic life and ask why you don’t have kids yet in your late 30s. 

Having a proper response may help you better deal with such instances. Author and veteran psychiatrist Dr. Abigail Brenner encourages a direct and firm expression of one’s sentiments, especially when the conversation becomes invasive. 

“Know when the discussion or argument has accelerated to the point of no return,” Dr. Brenner wrote in an article for Psychology Today, adding that ending the conversation is the best way to go when it deviates from conflict resolution and becomes more about winning. 

There’s also nothing wrong with dodging questions you’re not comfortable answering. It’s an excellent way to set boundaries, as long as you keep it diplomatic. 

“You’re allowed to say, ‘Thank you for asking, but I don’t feel like talking about it tonight’ or, ‘Oh, it’s a long story. We can discuss at another time,’” social psychologist Dr. Susan Newman told HuffPost

The author probably could have avoided laughing in his sister-in-law’s face. However, he responded straightforwardly and did not make retaliatory remarks. His sister-in-law likely embarrassed herself, causing her to storm off.

Please do find out if her running Lily's DNA is legal. The attempted "reveal" in front of the child is unforgivable. She's told you what she is, believe her. Ironically of course, there was an actual "reveal", it happened to be of SIL as a malignant attention seeking crazy who thinks nothing of hurting a child if she can get an afternoon's entertainment out of it.

IF this happened as told, and if I were in OP's shoes, my reaction would have been different. When psycho-woman came out with the bit about testing Lily's DNA against my brother's and there was no match, I'd have gone with 'I know, and as you're marrying my brother you're going to be a part of this family, so you need to know the family secret. My brother isn't really my brother. The baby my mum gave birth to was really, REALLY ugly so she switched him with a cuter one in the hospital. Don't tell anybody, though, 'cos the last two people who learned of it mysteriously vanished. Now, can I get you a coffee?"

(I promised I wouldn’t again tell my long winded history here in the comments, but it’s in previous ones) I’ve a similar stitch. Best friends hubby was KIA while she was in her 1st trimester, she was terminal & died shortly after childbirth. My husband & I went through the foster/adopt classes/process & have a beautiful 10yo son we took home from the hospital. We’re both men, so that’s a public challenge *daily* (given men with kids are often treated with suspicion) and we’ve completely different melanin levels than he. There’s no way he could have biologically been either of ours. You’d be amazed at how many people simply can’t mind their own business. You’d be frighteningly shocked with how many people, including law enforcement, believe that two men with a child is so suspect that it’s enough probable cause to suspend our constitutional and civil rights. We carry all his documents, because we’re questioned so often. We now are no longer detained since we carry the docs.

The woman obviously thrives on drama. But more importantly she illegally obtained a medical test on OPs daughter without permission from the child's legal parent. If I was him I'd pursue that because hus brother seeing him seriously wrong she is then maybe he'll see what a mistake being in a relationship with her would be. The fact that she did it in front of the child, is child abuse. It's already horrible that she did it in the first place and not in a "I'm so sorry to tell you, but I need you to know that your wife was cheating" way, but in a way that suggests she wants to hurt him or she wants to be right. That's already horrible. But the fact that she did it in front of the child in question, is downright emotional abuse and she should never be around the child again.

Performing a DNA test on anyone without their permission is illegal, as is doing so on someone else's child. That was an assault on a child and Op should involve the police. SIL should be arrested and charged with assaulting the child.

SIL could’ve simply asked about the picture of OP with Lily’s parents, and how he ended up as Lily’s dad/guardian. She would’ve gotten logical answers that should’ve been enough. It almost sounds like Lily’s parents had made OP her godfather, or he simply took on that role, so he would take care of her if something happened to both of them. What’s so damned difficult to understand about that? Life is not like some crappy soap opera or staged Reality TV show, ffs. There aren’t elaborate and unrealistic storylines, there’s just s**t that happens and we just have to improvise how to deal with it and hope it all turns out OK, because we’re not living a story that was created with issues that have solutions already pre-planned. We’re experiencing real life. So there’s no need for soap opera or spy story type of espionage to secretly obtain someone’s DNA without their knowledge (cops do it with a search warrant, regular people don’t have such authority) and have it tested to find out a child’s paternity. SIL is living in la-la land if she thinks this is proper behavior in real life. Bro is just stuck in the middle. He probably agrees with OP that it was really out of line for his fiancée to do that, but he also has to live with her, or at least spend a lot of time with her, while she rants about OP’s reaction to her unwanted and improper sleuthing. He’s just trying to juggle living with both sides and maintaining some semblance of peace, while being the poor monkey in the middle of a situation he didn’t create.

NTA but even if you went nuclear on her out of daughters earshot of course, I think you'd be ok. some solid lines have to be drawn the first being that she doesn't EVER talk like that about either of Lily's parents like that to you or to Lily or behind your backs. I would have gone off on her. Firstly, you can press charges for her illegal actions. She had no right, period. Had she asked , you would have stated the details assuming you wanted to do so. This is weird. If SIL used her husband's DNA then he must have known what she was doing. Why didn't he tell her about the adoption? She didn't discuss the results with her husband before making a scene. Both the brother and SIL sound like they should be avoided like the plague.

Since she was studying the portrait of you, Lily's parents and then somehow decided she needed to test the child and HER HUSBAND, I think she saw some form of family resemblance to him, not to you. Probably hoped her hunch about her husband not being the father would trigger you being the father. Sometimes drama queens get too deep into their own lies. She was most likely looking for answers she hoped wasn't true and then decided to go the way of hey, your daughter isn't yours! (Thank goodness my husband isn't her father either!) Type of stuff. But sounds like this woman has some very deep seated issues overall! I'd for sure not allow my daughter around her anymore.

I've had experience with this type of person. I did my preemie son's DNA test with a cheek swab. It was a commercial OTC test that took about a minute to collect using a fancy cotton swab with ridges. Not all of them require spitting in a vial for 20 minutes. We got back interesting info about both sides of the family. His father was adopted so while we knew we didn't know. So while it may be illegal it is really easy to get. However why didn't fsil just pull the guy aside and ask...or even just ask her fiance before spending cash to "get to the truth" if she used your Brothers dna too...why would he not know she did this also. Seems off

This is not legal in any way. It's not a grey area. Had this been produced as evidence in a court of law it would be inadmissible and the person who had the DNA test done through dishonest and illegal means would likely be be charged with a crime. The problem I have with the story is this, the brothers own DNA was used as a control, meaning a person who knew about the adoption just went along with his fiancé for what, a funny haha? Why did he not tell his fiancé about the child parentage to avoid a scene such as what happened here? If anyone in this story is the real AH or is the brother while his fiancé is an AH by proxy.

While it's relatively easy to get a DNA sample (hair in a comb or brush, a swab with the person's mouth cells on it), that doesn't mean one should do it! That's what OP's brother's GF did, and for what??? To play Maury Povich and embarrass OP and young Lily?? (For those outside the US and Canada, Maury Povich was a talk show host best known for conducting DNA and lie detector tests, with the help of professionals, to reveal to his guests whether their loved ones are faithful or not. Show's been cancelled but reruns still air, even online.) All GF did was embarrass herself, and OP's brother has better take a good, long look at what kind of person he is involved with, and make her apologize to BOTH OP and his little girl, then break things off!!

I am confused about why the brother's DNA would work to show they were not related. I don't think DNA works like that. Brother's don't have identical DNA. Even identical twins have changes in their DNA. This story does not make sense to me. Great story though.

If they tested OP's DNA, they were expecting to see about a 50% match to the girl. Since siblings share about 50% DNA, testing the girl's "uncle" was expected to show about 25% DNA match with the girl.

Adoptive parent here. This seems off. Unless the deceased parents had written specific instructions naming OP as the guardian, there is zero likelihood he'd be able to easily step in, as a stranger (non-relative) and just "keep" the child. His comments that he was unsure about parenthood make me believe that didn't happen. Also, have y'all done one of these DNA tests? So, we're to believe she secretly had the little girl spit into a tube at a family gathering, and OP didn't notice his daughter was missing. I call bs on this one.

IF this happened as told, and if I were in OP's shoes, my reaction would have been different. When psycho-woman came out with the bit about testing Lily's DNA against my brother's and there was no match, I'd have gone with 'I know, and as you're marrying my brother you're going to be a part of this family, so you need to know the family secret. My brother isn't really my brother. The baby my mum gave birth to was really, REALLY ugly so she switched him with a cuter one in the hospital. Don't tell anybody, though, 'cos the last two people who learned of it mysteriously vanished. Now, can I get you a coffee?"

(I promised I wouldn’t again tell my long winded history here in the comments, but it’s in previous ones) I’ve a similar stitch. Best friends hubby was KIA while she was in her 1st trimester, she was terminal & died shortly after childbirth. My husband & I went through the foster/adopt classes/process & have a beautiful 10yo son we took home from the hospital. We’re both men, so that’s a public challenge *daily* (given men with kids are often treated with suspicion) and we’ve completely different melanin levels than he. There’s no way he could have biologically been either of ours. You’d be amazed at how many people simply can’t mind their own business. You’d be frighteningly shocked with how many people, including law enforcement, believe that two men with a child is so suspect that it’s enough probable cause to suspend our constitutional and civil rights. We carry all his documents, because we’re questioned so often. We now are no longer detained since we carry the docs.

The fact that she did it in front of the child, is child abuse. It's already horrible that she did it in the first place and not in a "I'm so sorry to tell you, but I need you to know that your wife was cheating" way, but in a way that suggests she wants to hurt him or she wants to be right. That's already horrible. But the fact that she did it in front of the child in question, is downright emotional abuse and she should never be around the child again.

SIL could’ve simply asked about the picture of OP with Lily’s parents, and how he ended up as Lily’s dad/guardian. She would’ve gotten logical answers that should’ve been enough. It almost sounds like Lily’s parents had made OP her godfather, or he simply took on that role, so he would take care of her if something happened to both of them. What’s so damned difficult to understand about that? Life is not like some crappy soap opera or staged Reality TV show, ffs. There aren’t elaborate and unrealistic storylines, there’s just s**t that happens and we just have to improvise how to deal with it and hope it all turns out OK, because we’re not living a story that was created with issues that have solutions already pre-planned. We’re experiencing real life. So there’s no need for soap opera or spy story type of espionage to secretly obtain someone’s DNA without their knowledge (cops do it with a search warrant, regular people don’t have such authority) and have it tested to find out a child’s paternity. SIL is living in la-la land if she thinks this is proper behavior in real life. Bro is just stuck in the middle. He probably agrees with OP that it was really out of line for his fiancée to do that, but he also has to live with her, or at least spend a lot of time with her, while she rants about OP’s reaction to her unwanted and improper sleuthing. He’s just trying to juggle living with both sides and maintaining some semblance of peace, while being the poor monkey in the middle of a situation he didn’t create.

Since she was studying the portrait of you, Lily's parents and then somehow decided she needed to test the child and HER HUSBAND, I think she saw some form of family resemblance to him, not to you. Probably hoped her hunch about her husband not being the father would trigger you being the father. Sometimes drama queens get too deep into their own lies. She was most likely looking for answers she hoped wasn't true and then decided to go the way of hey, your daughter isn't yours! (Thank goodness my husband isn't her father either!) Type of stuff. Wow. Why hasn’t anyone told the SIL that there is this thing where one person talks, then another person responds. It’s almost like a…..conversation. During which a person can ask questions politely and get the answers. This nugget of information is gold to someone who is willing to spend $$$ on a DNA test without blinking.

The girl will remember what said and may confuse her years later. People always told my husband that my youngest wasn’t his, right in front of her. She remembers to this day and always wondered. She is a white skinned 1/2 Mexican! I think OP handled this with admirable grace. The way I would have put hands on her AND my brother. There’d have been a whole lot more than “family drama”. I would also advise cutting all contact with ANYONE who thinks her actions are justifiable, especially the brother.

I did my preemie son's DNA test with a cheek swab. It was a commercial OTC test that took about a minute to collect using a fancy cotton swab with ridges. Not all of them require spitting in a vial for 20 minutes. We got back interesting info about both sides of the family. His father was adopted so while we knew we didn't know. So while it may be illegal it is really easy to get. However why didn't fsil just pull the guy aside and ask...or even just ask her fiance before spending cash to "get to the truth" if she used your Brothers dna too...why would he not know she did this also. Seems off

Who told her she had ANY right to run the test? She isn’t even family yet! Had it been your brother, sister or parents, maybe could be considered concern for you, but of course they all know the whole story. What she dis was nosey, and feels illegal. Geez....How much did the OP's SIL spend on a DNA test to find out the answer to something that she could have found out about by simply asking her husband(boyfriend) She did a lot of sneaking around to end up looking like a fool. Sorry , but I probably would have laughed in her face also. I'm curious to know if she actually "likes" the OP and his daughter and why would she go to such great lengths to find out?

This is not legal in any way. It's not a grey area. Had this been produced as evidence in a court of law it would be inadmissible and the person who had the DNA test done through dishonest and illegal means would likely be be charged with a crime. The problem I have with the story is this, the brothers own DNA was used as a control, meaning a person who knew about the adoption just went along with his fiancé for what, a funny haha? Why did he not tell his fiancé about the child parentage to avoid a scene such as what happened here? If anyone in this story is the real AH or is the brother while his fiancé is an AH by proxy.

Fiance NOT sister-in-law, either way, I would not go around her any more, don't attend wedding, just avoid rest of life. She did this in front of people but you were NOT to respond in front of people. She lucky you only laughed. If she'd only just had a light come on why didn't she ask her fiance privately on the way home? I'm with the OP. What was her purpose in doing it? While it's relatively easy to get a DNA sample (hair in a comb or brush, a swab with the person's mouth cells on it), that doesn't mean one should do it! That's what OP's brother's GF did, and for what??? To play Maury Povich and embarrass OP and young Lily?? (For those outside the US and Canada, Maury Povich was a talk show host best known for conducting DNA and lie detector tests, with the help of professionals, to reveal to his guests whether their loved ones are faithful or not. Show's been cancelled but reruns still air, even online.) All GF did was embarrass herself, and OP's brother has better take a good, long look at what kind of person he is involved with, and make her apologize to BOTH OP and his little girl, then break things off!!

Keep your sil away from your daughter because she is going to start saying things to her like she really isn't family, she'd probably trying saying to her when she's older that her mom was a cheater and many many other ugly things to her. Do not let the sil around your daughter. Until your daughter is old enough to stand her ground with this bit##. If she'd bought up the photo to her fiance, and pointed out that daughter resembles the friend, and asked about it, she would have gotten the real facts without making a scene and embarassing herself. She is abviously sensing waning interest and is reacting by trying to control her partner even more, her insecurity is driving her to behave in crazy ways. Fiancee is also jealous of OPs happiness.

I am confused about why the brother's DNA would work to show they were not related. I don't think DNA works like that. Brother's don't have identical DNA. Even identical twins have changes in their DNA. This story does not make sense to me. Great story though.

If they tested OP's DNA, they were expecting to see about a 50% match to the girl. Since siblings share about 50% DNA, testing the girl's "uncle" was expected to show about 25% DNA match with the girl.

Adoptive parent here. This seems off. Unless the deceased parents had written specific instructions naming OP as the guardian, there is zero likelihood he'd be able to easily step in, as a stranger (non-relative) and just "keep" the child. His comments that he was unsure about parenthood make me believe that didn't happen. Also, have y'all done one of these DNA tests? So, we're to believe she secretly had the little girl spit into a tube at a family gathering, and OP didn't notice his daughter was missing. I call bs on this one.

He didn't just "keep" her - he legally adopted her & is not her guardian, nor her godfather, as in another post. He is her legal parent.
