It's because we're not great at supervising our kids over here and will hand a 3 years old anything to shut them up without noticing the thing has tiny parts in it that the kid will immediately stick in their mouth (because they're 3, so of course they will)

Because apparently a choking hazard, that the rest of the world successfully deals with by putting a warning on the foil and assuming the parents aren't complete morons, is considered a serious risk to children in the US.

It's not a ban on kinder toys specifically, but just that Kinder toys are one of few items that fall under a rather specific ban. Ban is for food (maybe just candy) that has something non-edible, completely surrounded by the food. (Sorry it's been a while since I looked it up, so can't remember specifics beyond that.)

It’s because the American government can’t amend a little act that states that anything that is either toxic or unnecessary for the consumption of the food or drink item is illegal to put in the said item to anything that is either toxic or will cause a choking hazard is illegal to put in a food or drink item because they are just too stupid to realise that the capsule inside is too damn big to go down someone’s throat unless they are a incredibly stupid adult. The Act in itself is a good thing, just too strict.

They aren't, ours just don't have toys.

The actual reason is a food purity law. The toys were not wrapped seperately and kept from touching the food. It was not due to choking kids. You can still buy Kinder eggs, they are just packaged differently with the toy seperated from the food, so not as popular and harder to find.

They are different sections in those for the toy and the egg but the whole chocolate egg with a capsule inside that was banned.

You know the constitution can change right? That's why that whole right to bear arms bit is even in it, the second AMENDMENT.
