Assistant Throws Herself A $2,000 Farewell Party As A Popularity Test, Ends Up Without A Job

Running your own company is a massive responsibility. You have staff depending on you for their livelihoods, and clients expecting work to be done. As a boss, it pays to have an assistant you can trust and depend on. One woman thought she had found that in a recently appointed employee. So she felt at ease going out of town for a conference recently.

Little did she know that a massive party was being thrown with company funds while she was away. But what shocked the boss most, was finding out her assistant had held the expensive “farewell” for herself. Despite not resigning, or even planning to leave. The assistant was fired on the spot, but her boss is now wondering if she made a mistake by letting her go.

Misappropriation of funds is a criminal offense and can have serious consequences

According to the Helfend Law Group, “Misappropriation of funds refers to the illegal use of another person’s money. While the person committing the offense was given lawful access to the money, it is the use for their own purposes or another unauthorized use that makes it a crime.”

Some could argue that the assistant got off lightly for using company money for her “fake farewell”. If Lily’s boss were to lay criminal charges, and she was found guilty, she could face imprisonment, fines, probation, and would have to deal with having a permanent criminal record.

The law firm notes that misappropriation of funds is similar to embezzlement “in which a person who is entrusted with another person’s money or property steals it for their own personal use.” And adds that in some cases, a person could be charged with both crimes.

There are certain things you’d need to prove to be found “not guilty” of misappropriation of funds

If you ever find yourself charged with misappropriation of funds, it’s probably best to hire a lawyer. But the Helfend Group says your legal team would need to prove a few things to get you off the hook.

For example, if there’s evidence that there was a “lack of intent” on your part. Meaning you didn’t intend to steal or misappropriate the funds. Or maybe you have proof that your company gave you consent to keep the money or use it for personal reasons.

You also might win your case if you can prove that you were wrongfully accused, coerced, were the victim of mistaken identity, or were forced to commit the crime through threats or violence.

There are some other scenarios where the charges could be dropped. One is if the evidence against you is inadmissible in court. For example, it was obtained illegally. Or if there isn’t enough evidence to prove beyond a reasonable doubt that you misappropriated the funds.

As others have said, this is an open and shut case of a con-artist stealing from you. Lily can do whatever social experiments she likes with her own money, but she didn't. What possible results could have come from the 'test' anyway? When someone announces they are leaving, people don't flood them with "no, please stay, we beg you" messages unless they are the main character in a novel. They leave, and everyone else gets on with their life. Lily expecting otherwise is either total self-delusion/narcissism, or a b******t excuse for theft.

Lily has severe main character syndrome. She's lucky she only got fired and not charged with theft. People who think Lily is the victim are dumb and are not good people to have as friends. In my experience, it's pretty rare for people to beg others to stay when they put in notice. Even if I like the person who is leaving, I trust that as an adult they can make their own decisions about their life. Anyway, Lily learned that whrn you misuse company money to get attention, the result of that experiment is being fired.

My first job as a lawyer was working for a trade union. I have worked to expand and enhance worker rights throughout my 30+ career. Usually I see a boss firing a worker and think "What an AH". NTA for firing her - your 1st instinct was absolutely correct - but WHY are you doubting your decision? Because she's blasting away on social media? Either way, it might be worth disputing the charges with your credit card issuer - unaurhorized/fraudulent use of the card - & let the vendors she paid with it come after her for payment if the card issuer bounces the charges back on them. No harm in trying - 50/50 chance of success. Just musing here - wouldn't it be interesting if the story of Lily, the Larcenous Loony, found its way into the press or onto some social media platform. (Take legal advice 1st - in fact, I hope the company has legal counsel to advise on how to proceed with the entire mess.) I'm guessing other farewell parties weren't this big or expensive. What are the other employees supposed to think if you let this go? It'll cause a lot of gossip and suspicions of favoritism. It would also show them that stealing from the company will be tolerated. Firing was appropriate, get your 2k back in court of you have to.

IMO I can see someone deciding $2000 isn't worth the court/lawyer costs, time, effort, and stress to pursue.

Have your lawyer send her a cease and desist letter, reminding her that you can still go after her to repay the money. Companies usually don’t go after people who misuse company funds like this because they don’t want the publicity. Instead, they just fire them. But you are getting the negative publicity anyway.

In larger companies I’ve seen a potluck during the day with a cake either purchased by the company or with donations. Sometimes there would be a second party at happy hour after work where everyone paid their own way. When the company has been very small as in ten employees or less the owner has usually taken everyone out on their dime, either to lunch or dinner and drinks.

I would have immediately fired her as soon as I got back also. Misuse of company funds, theft and whatever else she could be charged with.

Lily has severe main character syndrome. She's lucky she only got fired and not charged with theft. People who think Lily is the victim are dumb and are not good people to have as friends. In my experience, it's pretty rare for people to beg others to stay when they put in notice. Even if I like the person who is leaving, I trust that as an adult they can make their own decisions about their life. Anyway, Lily learned that whrn you misuse company money to get attention, the result of that experiment is being fired.

My first job as a lawyer was working for a trade union. I have worked to expand and enhance worker rights throughout my 30+ career. Usually I see a boss firing a worker and think "What an AH". Not this case; I would have fired this person. She is a crook and a fraud and deserved firing on the spot.

NTA for firing her - your 1st instinct was absolutely correct - but WHY are you doubting your decision? Because she's blasting away on social media? Because some random friends said her punishment was too severe? Buck up! She committed a crime, FGS, by using YOUR company's funds & should either be arrested or you should be suing her. Has she been told the $ has to be replaced immediately - or one of the 2 things in the previous sentence, maybe both, will happen? This is YOUR company - why would you want to have somebody as deranged & dishonest as she is as an employee? Who can imagine what k8nd of "experiment" she might try next? She claimed this was an experiment? If that's what she really, in her tiny thieving mind, thought she was doing, she should have done a little research on how to conduct an experiment. Giving people free food & a bar isn't really an objective way to find out how much you're appreciated. (Did she say how many begged her not to quit? So they could have more parties?) BTW, is there a company policy that prohibits alcohol on the premises? Another infraction? And nobody in HR or elsewhere in management with the cojones to shut down the bar? As for your your having "no respect for mental health & personal exploration," she desperately needs some mental health care & "personal exploration'' is just what it sounds like: something you do on your own personal time, outside of work. And, needless to say, with your own $. It sounds like there were already hints/clues that she was a bit "off." There needs to be somebody in HR with a finely-tuned "BS meter" to weed out wacko job candidates. Wondering - was she authorized to use the credit card at all? For legitimate company purposes? Either way, it might be worth disputing the charges with your credit card issuer - unaurhorized/fraudulent use of the card - & let the vendors she paid with it come after her for payment if the card issuer bounces the charges back on them. No harm in trying - 50/50 chance of success. Just musing here - wouldn't it be interesting if the story of Lily, the Larcenous Loony, found its way into the press or onto some social media platform. (Take legal advice 1st - in fact, I hope the company has legal counsel to advise on how to proceed with the entire mess.) Seriously, everybody, I make paragraphs when typing but then the post appears as just one block of text. Still can't figure out yet what to do to prevent that. It doesn't happen on Reddit so maybe the cute little panda just hates me.Apologies.

I'm guessing other farewell parties weren't this big or expensive. What are the other employees supposed to think if you let this go? It'll cause a lot of gossip and suspicions of favoritism. It would also show them that stealing from the company will be tolerated. Firing was appropriate, get your 2k back in court of you have to.

Was there a follow up on this? She should have been arrested by the police for the theft and sued for the slander. Why would the idiot commit a crime, then admit it on social media? It's the same as kids flming their crimes, and posting them on Tiktok for likes.

Lily 100% has mental health issues, none of that is normal behavior and feels very narcissistic. I think the owner dogged a major bullet by letting her go since Lily got on social media and double down. Literally a walking red flag. Get new friends too.

Here's the update from OP: "I’d like to thank everyone who responded and shared their opinions. I have decided not to take legal action against Lily because the $2,000 isn’t worth the stress of keeping her in my life. I see the $2,000 as the cost of her exit from it." I will note there's 31 down votes as of now and most of the responses are saying this is a fake post. Make your own decision. IMO I can see someone deciding $2000 isn't worth the court/lawyer costs, time, effort, and stress to pursue.

Have your lawyer send her a cease and desist letter, reminding her that you can still go after her to repay the money. Companies usually don’t go after people who misuse company funds like this because they don’t want the publicity. Instead, they just fire them. But you are getting the negative publicity anyway.

OK, I'm old-fashioned and it's a public services job...but if someone quits, THEY pay for farewell cake/snacks and (non alcoholic) drinks. Not the employer unless you're like head of everything. (actually, not even then.)

In larger companies I’ve seen a potluck during the day with a cake either purchased by the company or with donations. Sometimes there would be a second party at happy hour after work where everyone paid their own way. When the company has been very small as in ten employees or less the owner has usually taken everyone out on their dime, either to lunch or dinner and drinks.
